Terms of Service

1. Acceptance of Terms

By accessing and using the Curry Cares website (the "Service"), operated by Roofing By Curry ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Curry Cares is a community-driven charitable program that provides free roof installations to families in need. The Service allows community members to:

• Nominate families who are in need of a new roof
• Vote for nominated families during active voting periods
• View information about past winners and their stories
• Learn about the Curry Cares program and its mission

3. Eligibility

To use the Service, you must be at least 18 years of age or have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet this age requirement.

4. Nomination Process

When submitting a nomination, you agree to:

• Provide accurate and truthful information about the nominated family
• Obtain consent from the nominated family before submitting their information
• Provide accurate contact information for yourself and the nominated family
• Submit only one nomination per family per nomination cycle
• Not submit nominations for your own family or immediate relatives

We reserve the right to verify all information provided in nominations and to disqualify any nomination that contains false, misleading, or incomplete information.

5. Voting Process

When participating in voting, you agree to:

• Cast votes only during active voting periods
• Vote in good faith based on the information provided about each nominated family
• Not engage in any fraudulent voting practices, including but not limited to automated voting, vote manipulation, or creating multiple accounts to cast additional votes

We reserve the right to monitor voting activity and to disqualify or remove votes that we determine to be fraudulent or in violation of these Terms.

6. Selection of Winners

Winners are selected based on community voting and our internal review process. The selection process is at our sole discretion, and we reserve the right to:

• Verify the eligibility and need of nominated families
• Consider factors beyond vote count, including but not limited to the severity of need, location, and other relevant circumstances
• Disqualify any nomination or winner if we determine that the information provided was false or misleading
• Modify or cancel the program at any time without prior notice

All decisions regarding winner selection are final and not subject to appeal.

7. User Content

By submitting content (including but not limited to nominations, photos, stories, and comments) to the Service, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that:

• You own or have the necessary rights to all content you submit
• The content does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights
• The content is not defamatory, libelous, obscene, or otherwise unlawful
• You have obtained all necessary consents and releases from individuals featured in any photos or content you submit

8. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable federal, state, local, or international law or regulation
• Transmit any material that is abusive, harassing, defamatory, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
• Impersonate or attempt to impersonate another person or entity
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Roofing By Curry and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent, except as permitted by these Terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROOFING BY CURRY, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Roofing By Curry and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third party right, including without limitation any copyright, property, or privacy right
• Any claim that your content caused damage to a third party

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

14. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.

15. Governing Law

These Terms shall be interpreted and governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Roofing By Curry regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
